On October 24, 2011, Illinois State Bowling
Proprietors & Recreational Industry Workers' Compensation Trust was placed in
conservation by the Circuit Court of Cook County, Illinois, subject
to an Order of
Sequestration or confidentiality.
On December 5, 2011, the
Order of Sequestration was vacated. The
Order of Conservation remains in place.
On January 26, 2012, an Order of Rehabilitation with a Finding of Insolvency was entered against Illinois
State Bowling Proprietors’ & Recreational Industry Workers’ Compensation Trust by the Circuit Court of Cook
County, Illinois. In connection therewith, the Court has ordered that the Trust be placed in Rehabilitation
in accordance with Article XIII of the Illinois Insurance Code, 215 ILCS 5/187, et seq.
The Trust was organized pursuant to the Workers’ Compensation Pool Law, 215 ILCS 5/107a.01 et seq., and as such,
is not a member company of the Illinois Insurance Guaranty Fund. Guaranty fund protections are accordingly not
available to Illinois Bowling Trust policyholder members or claimants.
Claims for losses occurring on or before January 26, 2012 are subject to a temporary moratorium on payment, until
a Rehabilitation Plan is presented to and approved by the Court. However, under the terms of the applicable provisions
of the Rehabilitation Order, during the moratorium period, claims for temporary total disability payments, temporary
partial disability payments and prospective emergency medical treatment for an injured worker of a trust beneficiary
will continue to be paid by the Trust as hardship claims at the rate of seventy percent (70%) of the amount due or
past due, subject to true-up with the terms of any Rehabilitation Plan that is subsequently approved by the Supervisory Court.
Claimants may also be entitled to receive additional compensation toward satisfaction of their claims from the Group
Workers Compensation Pool Insolvency Fund pursuant to 215 ILCS 5/107a.13.
The Trust will continue to defend claims against its policyholder members, subject to the provisions of the Order
of Rehabilitation and any Rehabilitation Plan that is subsequently approved by the Court. New covered claims and requests
